Deciphering the Meaning Behind the “Right to Bear Arms”

Let’s analyze the aforementioned sentence. “Militia” refers to the American people.

As George Mason explained it:

“I ask, sir, what is the militia? It is the whole people, except for a  few public officials.”

Therefore, the Founding Fathers thought that US citizens should be able to defend themselves against a tyrannical government, and any other potential threat to their personal wellbeing, and freedom.

Citizens were granted this right through the ability to defend themselves and their property. What’s more, the final line of the sentence, “ the right of the people to keep and bear Arms, shall not be infringed. ”, supports the individual rights of citizens to own legal firearms, without the government being able to interfere with that.

However, this is one of the ways to interpret the meaning of this famous sentence. According to some people, “a well regulated militia” applies only to private militia organizations, like the National Guard, and Naval Militia, and not to all individuals.

In all honesty, though, much has changed since 1791. Back then, civilians usually had the same firearms at home as the ones the army were using, since all white males between the age of 18 and 45 were obligated to serve in state militias, whenever the need arose.

Nowadays, soldiers are equipped with modern weapons that greatly differ from the weapons that regular people own.

Ups and Downs of the Second Amendment

Those who support the right to bear arms, support it for the following reasons:

• Self-defense . Perhaps the most prevalent reason for supporting the Second Amendment is the ability to be able to protect yourself, and your family. In favor of this comes a study published in the Journal of Interpersonal Violence.  The study found that people who used guns in self-defense were less likely to be killed or harmed than those who used alternative methods for self-defense.
• Hunting and recreational shooting . Another argument in favor of gun ownership is the use of firearms for hunting and recreational shooting. Possessing firearms is indispensable for outdoor activities like target shooting, or hunting. Hunting, in particular, generates billions of dollars for the US economy, while target shooting is a popular activity with around 20 million Americans partaking in it.
• Protection against tyranny . Many people look at historical examples of tyrannical governments, and use it as an argument defending their right to bear arms. For instance, the Soviet Union, and Nazi Germany both disarmed the population before enforcing authoritarian regimes.

People who are against gun ownership, justify it with:

• Public safety . One of the major arguments against gun ownership is the increasing concern for public, and child safety. Nearly 40,000 people in the US died from guns in 2019, and some studies are linking higher rates of gun possession with higher rates of firearms-related deaths. 
• Accidental shootings and suicides . 60% (23,941) of the aforementioned 40,000 gun-related deaths in 2019, were suicides. The logical assumption of civilians who oppose gun ownership is that having firearms in the household increases the risk of suicide for people with depression, or other mental health issues.
• Mass shootings . Gun opponents say that easy access to firearms makes it easier for anyone to grab a gun, and start shooting. The frequency of mass shootings in the US proves that, with 611 mass shootings in 2022 alone, killing over 18,000 people.

Second Amendment Court Cases

The Second Amendment has been the subject of numerous court cases throughout history.

The first notable case was United States v. Cruikshank (1876). It was a landmark Supreme Court case that dealt with the enforcement of civil rights protections under the Fourteenth Amendment.

The case arose from the Colfax Massacre in Louisiana, where a mob of white supremacists attacked and killed over 100 Black Americans. The Supreme Court’s decision in this instance severely limited the federal government’s capacity to safeguard individuals’ civil liberties from being violated by intruders.

For example, the Supreme Court’s ruling in District of Columbia v. Heller highlights the importance of the Second Amendment in protecting individuals’ rights to carry a weapon for protection within their own homes.

Another notable case is the decision of the Court in McDonald v. City of Chicago. It also has significant implications as it extended the scope of the Heller case decision to include state and local entities, ensuring that the Second Amendment rights of individuals are safeguarded throughout the country.

The exact text of the ruling reads:

“… the Fourteenth Amendment incorporates the Second Amendment right, recognized in Heller, to keep and bear arms for the purpose of self-defense.”

Most recently, New York State Rifle & Pistol Association, Inc. v. Bruen was a recent Supreme Court case that addressed the constitutionality of New York’s concealed carry licensing law.

The case ruled that the law’s requirement for individuals to demonstrate “proper cause” to carry a concealed firearm violated the Second Amendment rights of law-abiding citizens.

Moreover, the court ruled that the prohibition on carrying firearms outside the home violated the right to self-defense.
